accessing and using the services of KoliVivah you agree to be bound by these Terms of Use.
If you do not agree to be bound by these Terms Of Use, please do not access or use
KoliVivah.
We reserve the right to modify the Terms of Use at any time without giving any prior notice to
you. Your use of KoliVivah following any such modification constitutes your agreement
to follow and be bound by the Terms Of Use as modified.
Any additional terms and conditions, disclaimers, privacy policies and other policies applicable
to general and specific areas of KoliVivah or to particular content are also
considered as Terms Of Use.
AGE RESTRICTIONS. KoliVivah IS ONLY AVAILABLE FOR ADULTS (INDIVIDUALS AGED 18 YEARS OR OLDER).
NO USE BY UNDERAGE PERSONS. NO PERSONS UNDER THE AGE OF EIGHTEEN (18) YEARS (TWENTY-ONE (21) YEARS IN PLACES WHERE EIGHTEEN (18) YEARS IS NOT THE AGE OF MAJORITY) MAY DIRECTLY OR INDIRECTLY VIEW, POSSESS OR OTHERWISE USE KoliVivah.
YOU MUST BE A LEGAL ADULT. YOU HEREBY AFFIRM AND WARRANT THAT YOU ARE CURRENTLY EIGHTEEN (18) YEARS OF AGE OR OVER (TWENTY-ONE (21) YEARS IN PLACES WHERE EIGHTEEN (18) YEARS IS NOT THE AGE OF MAJORITY) AND YOU ARE CAPABLE OF LAWFULLY ENTERING INTO AND PERFORMING ALL THE OBLIGATIONS SET FORTH IN THIS AGREEMENT.
SAFETY. KoliVivah IS NOT RESPONSIBLE FOR YOUR USE OF THE KoliVivah OR FOR THE ACTIONS OF OTHER USERS WITH WHOM YOU MAY EXCHANGE INFORMATION OR HAVE CONTACT.
- KoliVivah DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS OF ITS USERS.
- KoliVivah DOES NOT VERIFY THE INFORMATION PROVIDED BY USERS WITH RESPECT TO USERS’ HEALTH, PHYSICAL CONDITION, OR OTHERWISE.
- KoliVivah ALSO IS NOT RESPONSIBLE FOR ACTIVITIES OR LEGAL CONSEQUENCES OF YOUR USE IN LOCATIONS WHICH MAY ATTEMPT TO CRIMINALIZE OR LIMIT YOUR PERSONAL INTERACTIONS. YOU MUST MAKE YOUR OWN INFORMED DECISIONS ABOUT USE OF THE APPLICATION IN YOUR LOCATION AND ASSESS ANY POTENTIAL ADVERSE CONSEQUENCES.
Registration
In order to use the general services offered by KoliVivah You need not be a
registered user of KoliVivah. If registration is requested, You agree to provide
KoliVivah with accurate and complete registration information.
For registering with KoliVivah You will be asked to provide certain information
including without limitation your name, contact number and a valid email address. Read our
Privacy Policy on how we use your personal information.
Use of KoliVivah
You are not adviced to use KoliVivah if you are not above 18 years of age.
You may use KoliVivah and any information hosted on KoliVivah but
not limited to writings, comments, personal messages, files (.doc, pdf, ppt, audio & video), images
and other work, document or information that You see, hear or otherwise experience on
KoliVivah (singly or collectively, the "content") solely for Your personal
purpose
only.
Content submission
We act as a channel for the online posting, distribution and publication of user-submitted
Content and have no obligation to screen communications or Content in advance and are not responsible
for screening or monitoring any material posted by users.
If notified by a user of communications which allegedly do not confirm to these Terms and
Conditions, We may investigate the allegation and determine in good faith and it's Our sole discretion
whether to remove or request the removal of such communication.
By submitting content to any public or non-public area of KoliVivah, including
message boards, forums, contests and chat rooms, you grant us and Our affiliates a royalty-free,
perpetual, irrevocable, sub license able (through multiple tiers), non-exclusive right (including any moral
rights) and license to use, reproduce, modify, adapt, publish, translate, create derivative
works from, distribute, communicate to the public, perform and display the content (in whole or in
part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or
later developed, for the full term of any rights that may exist in such content.
You also warrant that the holder of any rights, including moral rights in such content, has
completely and effectively waived all such rights and validly and irrevocably granted to you the
right to grant the license stated above. You also permit any user to access, display, view,
store and reproduce such content for personal use. Subject to the foregoing, the owner of such content
placed on KoliVivah retains any and all rights that may exist in such
content.
Content disclaimer
KoliVivah communicates information provided and created by advertisers, listing
agencies, publishers, users, resellers, third parties and You. KoliVivah have no
control over the accuracy, legality, legitimacy, validity or reliability of such information on
KoliVivah, which may also include technical inaccuracies or typographical errors.
KoliVivah makes no guarantee, nor take any responsibility for the content
including its quality, copyright compliance or legality, or any resulting loss or damage. The content not
limited to the availability of any product or service or any feature thereof, is subject to
change without notice. KoliVivah reserves the right, in sole discretion and without any
obligation, to make improvements to, or correct any error or omissions in, any portion of
KoliVivah.
Listing Policy and Conduct
Duplicate user profiles are not allowed: Any user create more than one profile would be
considered as a Duplicate user profile. All duplicate profiles would be deleted and the your account will
be liable for suspension.
Availability of User Profile listing: The free listing service on vadhuvarsuchakkendra.com is
available without any guarantee or warranty. We don't assure your Profile will appear on our
website all the time as We reserve the right to remove any listing which violates the 'Terms of
Use'.
You agree not to post, email, submit, or otherwise make available Content:
- that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or is harmful to minors in any way;
- that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
- that constitutes, contains, offers or solicits prostitution; bestiality; child pornography;
- that impersonates any person or entity, including, but not limited to, a KoliVivah employee, or falsely states or otherwise misrepresents your affiliation with a person or entity (this provision does not apply to Content that constitutes lawful non-deceptive parody of public figures.);
- that includes personal or identifying information about another person without that person's explicit consent;
- that is false, deceptive, misleading, deceitful, or constitutes "bait and switch";
- that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, or Content that you do not have a right to make available under any law or under contractual or fiduciary relationships;
- that constitutes or contains "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement;
- that constitutes or contains any form of advertising or solicitation if: posted in areas of the KoliVivah sites which are not designated for such purposes; or emailed to KoliVivah users who have not indicated in writing that it is ok to contact them about other services, products or commercial interests.
- that advertises any illegal service or the sale of any items the sale of which is prohibited or restricted by any applicable law. A partial list of prohibited items for sale and prohibited services offered is provided below for your convenience:
- weapons; firearms/guns and components; BB/pellet, stun, and spear guns; etc
- ammunition, clips, cartridges, reloading materials, gunpowder, fireworks, explosives
- hazardous materials; body parts/fluids; unsanitized bedding/clothing
- prescription drugs, medical devices; controlled substances and related items
- alcohol or tobacco; unpackaged or adulterated food or cosmetics
- child pornography; bestiality; offers or solicitation of illegal prostitution
- pet sales (re-homing with small adoption fee ok), animal parts, stud service
- endangered, imperiled and/or protected species and any parts thereof, e.g. ivory
- false, misleading, deceptive, or fraudulent content; bait and switch; keyword spam
- offensive, obscene, defamatory, threatening, or malicious postings or email
- anyone’s personal, identifying, confidential or proprietary information
- food stamps, WIC vouchers, SNAP or WIC goods, governmental assistance
- stolen property, property with serial number removed/altered, burglary tools, etc
- ID cards, licenses, police insignia, government documents, birth certificates, etc
- military items not demilitarized in accord with Defense Department policy
- counterfeit, replica, or pirated items; tickets or gift cards that restrict transfer
- lottery or raffle tickets, sweepstakes entries, slot machines, gambling items
- spam; miscategorized, overposted, cross-posted, or nonlocal content
- postings or email the primary purpose of which is to drive traffic to a website
- postings or email offering, promoting, or linking to unsolicited products or services
- affiliate marketing; network, or multi-level marketing; pyramid schemes
- any good, service, or content that violates the law or legal rights of others
- that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
- that disrupts the normal flow of dialogue with an excessive amount of Content (flooding attack) to KoliVivah, or that otherwise negatively affects other users' ability to use KoliVivah;
- that employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of Content transmitted through the Service.
Additionally, you agree not to:
- contact anyone who has asked not to be contacted, or make unsolicited contact with anyone for any commercial purpose;
- "stalk" or otherwise harass anyone;
- collect personal data about other users for commercial or unlawful purposes;
- use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Service - unless expressly permitted by KoliVivah;
- post non-local or otherwise irrelevant Content, repeatedly post the same or similar Content or otherwise impose an unreasonable or disproportionately large load on our infrastructure;
- post the same item or service in more than one classified category or in more than one metropolitan area;
- attempt to gain unauthorized access to KoliVivah computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the of the KoliVivah website; or
- use any form of automated device or computer program that enables the submission of postings on KoliVivah without each posting being manually entered by the author thereof (an "automated posting device"), including without limitation, the use of any such automated posting device to submit postings in bulk, or for automatic submission of postings at regular intervals, unless otherwise approved in writing by KoliVivah; or
- use any form of automated device or computer program ("flagging tool") that enables the use of KoliVivah "flagging system" or other community moderation systems without each flag being manually entered by the person that initiates the flag (an "automated flagging device"), or use the flagging tool to remove posts of competitors, or to remove posts without a good faith belief that the post being flagged violates these Terms.
Linking to third party websites or links:- Links to external Internet websites are provided
within KoliVivah as a matter of convenience to you. The listing of such external
websites or links does not imply endorsement of such websites or links by KoliVivah.
KoliVivah do not make any representations regarding the availability, reliability
and performance of the third party links or websites. If You click on any advertisement banner,
sponsor link, or any other external link from or available on KoliVivah, your browser
automatically directs you to the third party website that is not hosted or controlled by
KoliVivah and KoliVivah don't assume responsibility for the
content, functionality or technological safety of these external third party links/websites.
Warranty disclaimer
Any use of KoliVivah and any use of the content shall be at your sole risk. we
disclaim any and all responsibility or liability for the accuracy, completeness, legality,
legitimacy, validity, reliability, interoperability or availability of the content, information
or material displayed on KoliVivah. KoliVivah (including all content
herein) are provided "as is" and are available without warranty of any kind, either express or
implied or statutory, including, but not limited to, the implied warranties of merchantability,
fitness for a particular purpose, or non-infringement. KoliVivah disclaims to the
fullest extent permitted under law any warranties regarding the security, reliability,
timeliness, accuracy and performance of KoliVivah and any content hosted on it. we do not
warrant that any defects or errors will be corrected; or that the content is error-free, free of viruses
or other harmful components.
Limitation of liability
In no event shall KoliVivah be liable to any user on account of any use, misuse or
reliance on KoliVivah for any damages whatsoever, including direct, special,
punitive, indirect, consequential or incidental damages or damages for loss of profits, revenue,
use, or data whether brought in warranty, contract, intellectual property infringement, tort
(including negligence) or other theory, even if we are aware of or have been advised of the
possibility of such damage, arising out of or connected with the use (or inability to use) or
performance of KoliVivah. we do not assume any legal liability or responsibility
for the accuracy, completeness, or usefulness of any information, content, product, services, or
processes disclosed on KoliVivah or any other material or information accessible
from KoliVivah. The foregoing limitations shall apply not with standing any failure of
the essential purpose of any limited remedy and to the fullest extent permitted under applicable
law.
Indemnity
You shall indemnify, defend and hold us harmless, and all Our officers, directors, owners,
agents, employees, content providers, partners, suppliers, affiliates, licensors and licensees
(collectively, the "Indemnified Parties") from and against any and all losses, damages,
liabilities, and claims and all fees, costs, expenses, of any kind related thereto (including, without
limitation, reasonable attorneys' fees) incurred by the Indemnified Parties in connection with
any claim arising out of, based upon or resulting from Your use of KoliVivah and or
Content. We reserve the right, at our own expense, to assume the exclusive defense and control
of any matter otherwise subject to indemnification by You and You shall not in any event settle any
matter without prior written consent from KoliVivah.
Termination and consequences
KoliVivah reserves the right to terminate or suspend your account if you violate
any of the Terms of Use or when We have reasonable grounds to believe that you have violated any of
the herein mentioned terms, We may at any point of time, either temporarily or indefinitely,
terminate Your access to KoliVivah or any part thereof without waiving any other rights and
without giving any prior notice to you.
Governing law and jurisdiction
The Terms of Use and any action related here to shall be governed by the laws of India without
reference to the conflict of laws provisions thereof. KoliVivah and you hereby
agree on behalf of yourselves and any person claiming by or through you that the sole and exclusive
jurisdiction and venue for any litigation arising from or relating to the Terms of Use or the
subject matter hereof shall be adjudicated at an appropriate court located in Pune in the State
of Maharashtra, India.
